BOISE BINS DUMPSTER RENTAL AGREEMENT This Agreement is made between Boise Bins ("Company") and the undersigned customer ("Customer") for the rental of a roll-off dumpster. 1. SERVICES PROVIDED Boise Bins agrees to deliver and rent a 15-yard roll-off dumpster to the Customer for disposal of non-hazardous solid waste. Delivery and pickup shall occur on the dates scheduled during online booking or by phone. Same-day swaps or pickups must be scheduled with at least four (4) hours' notice. If not, a $150 same-day service fee will apply. 2. RENTAL RATES 2.1 Base Rental - $280 for 1 day - Includes one dump and up to 1 ton (2,000 lbs) of waste 2.2 Additional Day Charges Each extra day is charged at the rate for the day it falls in: - Days 2–3: $57.50 per day - Days 4–7: $28.75 per day - Days 8–14: $25 per day - Days 15–30: $20 per day Those rates add up to $410 for 3 days, and $545 for 7 days. 2.3 Monthly Flat Rate - $1,300 (includes 2 dumps, 1 ton each) Note: No refunds will be issued for early returns during long-term or monthly rentals. 3. DUMP AND WEIGHT TERMS - Each rental includes one dump and up to 1 ton (2,000 lbs) of waste - Additional weight is charged at $0.03 per pound - Additional dumps are billed at $120 each - Maximum total weight allowed: 7,000 lbs - Loads exceeding this limit may be rejected, and the Customer may be required to off-load the container 4. CUSTOMER RESPONSIBILITIES The Customer agrees to: - Not overload the dumpster beyond the top rim - Not move the dumpster with personal or third-party equipment - Inspect the dumpster upon delivery for preexisting damage - Schedule pickup of the dumpster upon project completion 5. FEES AND CHARGES 5.1 Dry Run Fees If Boise Bins cannot retrieve the dumpster due to obstruction or inaccessibility, a dry run charge of $100–$250 will apply. 5.2 Restricted Materials Handling Customers may be billed at third-party remediation rates plus 20% for cleanup if restricted materials are loaded. 6. PROHIBITED MATERIALS Customer shall not dispose of the following items in any Boise Bins dumpster: - Concrete, bricks, rocks, or dirt - Liquids, oils, paint, solvents, or paint cans - Tires, batteries, vehicle parts, propane/fuel tanks - Appliances with refrigerants - Electronics (TVs, monitors) - Ashes, sewage, toxic or hazardous substances Any disposal of prohibited materials may result in additional fees, refusal of service, and liability for remediation. 7. LIABILITY & SURFACE DAMAGE The Customer acknowledges that Boise Bins is not responsible for damage to driveways, concrete, pavement, lawns, landscaping, or underground utilities resulting from delivery, placement, or removal of the dumpster. 8. WASTE INSPECTION & TITLE Boise Bins reserves the right to inspect, test, or reject any load. Title and liability for Prohibited Waste remain with the Customer at all times. 9. PAYMENT TERMS Prepayment by debit or credit card is required at the time of booking. The Customer authorizes Boise Bins to retain the payment method on file until the account is settled in full. 10. ENTIRE AGREEMENT This Agreement represents the entire understanding between Boise Bins and the Customer and supersedes all prior discussions or communications. 11. ACKNOWLEDGEMENT By signing below, the Customer acknowledges that they have read, understood, and agree to be bound by all terms and conditions contained in this Agreement, including any product-specific provisions applicable to the equipment being rented. 12. TRAILER RENTAL EQUIPMENT Boise Bins agrees to rent to Customer the trailer identified in the reservation, together with any accessories, locks, straps, hitches, or related equipment provided by Boise Bins. 13. CUSTOMER RESPONSIBILITY FOR TRAILER Customer accepts full responsibility for the trailer from the time it is picked up, delivered, or otherwise placed into Customer's possession until it is returned to Boise Bins. Customer shall be responsible for any loss, theft, vandalism, collision damage, tire damage, wheel damage, roof damage, ramp door damage, hitch damage, interior damage, frame damage, excessive wear, or other physical damage occurring during the rental period. 14. TOW VEHICLE REQUIREMENTS Customer represents and warrants that: • The towing vehicle is properly equipped and rated to tow the trailer and intended load. • The hitch, ball, safety chains, electrical connector, and any required braking systems are properly installed and functioning. • The driver possesses all licenses required by law. Boise Bins makes no representation regarding the suitability of Customer's vehicle for towing. 15. CARGO RESPONSIBILITY Customer is solely responsible for all cargo loaded into the trailer. Boise Bins shall not be responsible for cargo loss, cargo theft, cargo damage, weather-related damage, water intrusion, road debris damage, improper loading, or improperly secured cargo. 16. PERMITTED AND PROHIBITED USES Customer may operate the trailer on paved roads, gravel roads, forest roads, construction sites, campsites, hunting areas, and similar locations at Customer's own risk. The trailer shall not be: • Used for unlawful purposes. • Operated in a reckless or negligent manner. • Used in racing or competitive events. • Subleased, transferred, or loaned to another person. • Taken outside the United States without prior written approval from Boise Bins. • Operated in a manner inconsistent with its intended use or in a manner that creates an unreasonable risk of damage. Customer remains fully responsible for any damage, loss, excessive wear, recovery costs, or repairs resulting from use of the trailer regardless of location or road conditions. 17. ACCIDENTS AND DAMAGE REPORTING Customer shall immediately notify Boise Bins of any accident, theft, attempted theft, damage, impoundment, seizure, or law enforcement contact involving the trailer. 18. INSURANCE Customer acknowledges that Boise Bins does not provide insurance coverage for the Customer, towing vehicle, trailer contents, personal property, or third-party liability claims. Customer is solely responsible for verifying and maintaining adequate insurance coverage. 19. LIABILITY FOR LOSS OR DAMAGE Customer shall reimburse Boise Bins for all losses arising from damage to or loss of the trailer, including but not limited to: • Repair costs. • Replacement parts. • Diminished value. • Loss of rental income while the trailer is unavailable for rent. • Recovery expenses. • Towing charges. • Storage fees. • Administrative costs. 20. THEFT, ABANDONMENT, OR TOTAL LOSS If the trailer is stolen, abandoned, impounded, seized, destroyed, or deemed a total loss while in Customer's possession, Customer shall be liable for the fair market replacement value of the trailer together with all related expenses incurred by Boise Bins. 21. AUTHORIZATION FOR ADDITIONAL CHARGES Customer expressly authorizes Boise Bins to charge any payment method on file for unpaid rental charges, damage claims, cleaning fees, missing equipment, towing costs, recovery expenses, repair costs, replacement costs, loss of rental income, and any other amounts owed under this Agreement without requiring additional authorization at the time such charges are incurred.
